The two models differ in who files the petition. Under direct employer sponsorship, a single company serves as both your employer and your petitioner, so your lawful status moves in step with that one employment relationship. Under the agent model, a representation firm like Excelsior serves as petitioner of record, while the underlying engagements on your itinerary can span multiple employers, consulting arrangements, and self-directed projects. For professionals whose work spans multiple institutions, the agent model reflects how their careers already function.
An agent-filed O-1 covers an itinerary of professional engagements submitted with the petition. That itinerary can include full-time positions, short-term contracts, consulting arrangements, advisory board seats, speaking engagements, and self-directed projects — all within the scope of the beneficiary's extraordinary ability. As new opportunities arise, itineraries can be amended. Each engagement is documented and coordinated with the employers involved, which is where our operational work takes place: establishing the contractual relationships and communication channels that allow the itinerary to function day to day.
Excelsior Talent LLC operates purely as a talent representation firm. All legal strategy, petition drafting, and correspondence with USCIS remain the domain of your licensed immigration attorney. Our role is the agency side of the equation: serving as the petitioner of record, maintaining relationships with employers on your itinerary, and supporting the professional context that the legal filing rests on. Clients typically engage an immigration attorney independently before or during our onboarding process.
The agent model can be well-suited to founders whose professional activity spans more than a single venture. Rather than structuring the petition around one company, an agent-filed O-1 rests on an itinerary of concurrent engagements — which may include your own startup alongside advisory work, consulting, or collaborative projects. Whether this structure makes sense for your specific situation is a question for your immigration attorney to evaluate based on the facts of your case.
A first call is typically twenty to thirty minutes. We ask about your professional background, current and prospective U.S. engagements, and career goals over the next few years. We will share our perspective on whether the agent model is a practical fit for how you plan to work — a business conversation about what representation with us would actually look like, while legal questions remain with your attorney. If we move forward, the next steps involve coordinating with your attorney and mapping out the itinerary that will anchor the petition.
